By accessing and using Fluxend ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Fluxend provides a backend-as-a-service platform for developers. Our Service includes but is not limited to:

  • API endpoints and infrastructure
  • Database management
  • Authentication services
  • Real-time data synchronization
  • Developer tools and SDKs

3. User Accounts

To use certain features of our Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

You agree not to use the Service to:

7. API Usage and Limits

Use of our API is subject to rate limits and usage quotas as specified in your plan. Exceeding these limits may result in temporary suspension of access or additional charges.

8. Payment Terms

If you subscribe to a paid plan:

  • You agree to pay all fees according to your selected plan
  • Fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice
  • You are responsible for all taxes associated with your use of the Service

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

IN NO EVENT SHALL FLUXEND, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to defend, indemnify, and hold harmless Fluxend and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
